If you ask me who is wrong in this whole issue, then it's the gov n police. It is them that hyped up this issue to ridiculous proportion. Police/gov is supposed to be following the law as it is stated. The huge amount of interpretation on top of the law is ridiculous right now.
Photoing n Videoing yourself having sex or whatever, I think nothing is wrong with that, not legally at least, unless one or both party is not aware of it.
Publishing photos that does not belong to you, copy right law? I mean if it's just because it's of explicit content then it's completely BS, cuz people do it everday. I guess they can still argue that "not arresting people for it doesn't mean it was legal all along". Possessing is even more ridiculous, that's not even how the HK law goes. Saying possessing large amount of such content implies motivation to publish is as ridiculous as saying posessing a knife implies you will kill someone with it, and thus the possessor should be arrested....
Finally, I'd say the person most at ethical fault for all these pics, is the person who stole personal data from the owner's computer. I mean, I bring my comp to fix, why does it mean that my personal data is free to grab? Shouldn't that trigger some privacy law? If not, should the problem lies in the HK legal system in that there is not enough privacty protection law against personal data theft?
