For this particular case, I think it's just a matter of establishing a consistent legal definition of a 'man' and a 'woman'. If there's gray area, it's all just lawyer vs lawyer/judge... Aka money talks, as always.
In general, IMO, I think it's ok for a transgender to adopt legal recognition of the post transexual gender. Need to get into the technicalities tho of what constitutes the minimum necassary to be qualified as a legal man/woman tho. Aka. change of primary sexual organ + secondary feature? + hormone adjustments?, etc etc. Given that, if one is recognized legally as a man/woman, he/she should have all the rights/restrictions associated with being one. |
