Stupid Diamond Parking has given me two bogus tickets.  Here are the stories:

Ticket #1.
Diamond claimed that I walked off a lot on Cambie & 42nd on one Saturday in mid-June, but I was actually there to take out $ from bank.  I NEVER received any tickets until recently, when they suddenly hit me with a FINAL COLLECTION notice, w/ penalty and interests as well as a threat to destroy my credits and to tow away my car if they see it again.  And because this is a final notice, any opportunities to waive the ticket are taken away.

This car's insurance is under my own name.  And I've already cancelled its license and switched to storage insurance cuz I only drive it during summer.  Hence I'm not very worried abt it getting towed away in the future.

And of coz I can't find that little receipt from the ATM.  I mean who the hell would've expected this when I didn't even see a ticket on my windshield?  My bank statements don't show that I was there on that day, cuz it was a Saturday, so the transaction was posted in their system on Monday.  Later on I asked one of the bank's manager to write me a letter saying that I was really there to withdraw $ on that particular day, and didn't walk away from the lot as they claimed.

Now, would this bank letter help me to dispute the ticket?  I mean, their effing so-called "final collection notice" states that I've forfeited my chance to waive this ticket as I've been ignoring them (fk man I nvr got anything from Diamond until this final notice letter!)

Ticket #2.
Two mths ago, I went to work, and parked my car in front of Chapters on No.3 (an Impark Lot, nth to do w/ this ticket) from 11am til approx 1:55, right before the 3-hr limit ended.  Then I moved my car to Save-On-Foods during my lunch break and parked there from 2-4:30, also well within the 3-hr limit of this Diamond Lot.  Then I got a ticket saying that I parked from 1-4:20 which has exceeded the 3-hr limit.  Oh heck, I was still on the Impark lot in front of Chapters from 1-1:55!!!
I hvn't had a chance to talk to my manager to get proof that I was still working at 1pm, which I must admit is my bad.  Now they're sending me another final notice, saying that they'll do sth to my credits, take legal actions, as well as take away my right to waive the ticket, blah blah blah.

Some ppl say that I can just change license plate (e.g. ticket #1).  But that will only avoid the towing part, not the legal action / credit part.

Some say that I can ignore them, they can't really touch ur credit.  If they call u, ask them to mail you instead.
Still, I don't like to be bugged like this.  Particularly for ticket #2, that car's insurance is under my mom's name, not mine (like ticket #1).  I don't wanna affect her credit.

And please don't say that I should just pay for them.  I don't wanna pay for a violation I didn't commit.  I still want to dispute them for sure.  But seeing that the two letters say that "any opportunity to have this ticket waived has now been forfeited" kinda worries me, even though I have the proof.

I guess the only thing I can do now, is be tough and call them.
But I dunno... I'm a very soft person and I'm not very good at dealing w/ this kinda bs.  Anyone knows how they go about w/ this kinda bogus tickets?

Any success stories or constructive advices would be helpful.  Thanks.

P.S.  Something like "I parked 2 mins over my paid hrs and they gave me a ticket they're such an @sshole" is not 俾人屈 ticket.  Please refrain from ranting about those here.  Thanks.

Oh thx for reading the long long post...
Thank you in advance for any comments.

I mean... what's the worst that they can do?
They can't auto debit $ from my bank like credit cards.
And it'll take them $ to take legal actions w/ lawyers.
So what's the worst that can happen?

Can you call them and calmly explained the situation?  Incident #1, explained you didn't got it a ticket in your dash, maybe the wind blew it away etc, and explained you were in the bank ATM machine, hence didn't walk off the lot.  And same with Incident #2, explained to them that you went there around 2 yish, and see if they are able to work something out with you.

For sure I'll give them a call.  But since the letters say that I've forfeit my chance to waive the tickets, I dun think they'll go down that easily lor

They actually cannot do anything to you except towing your car (if it is still w/ the same license plate) if you park on their property again. A parking ticket and fine from a private parking lot will not and cannot affect your credit rating. You did not borrow money from them and not pay it back. Putting it on a credit report would be laughable, as there is no legitimate agreement and no debt owed. The credit reporting agencies aren't interested in hearing from parking companies. It has no legitimacy unless they take it to small claims court, show proof of the trespass, and get a ruling from the judge. And they won't do that because it would cost them too much, not to mention that the court would be backed up until the next century if they allowed such cases. If they send collections after you, just ignore. They will go away. However, parking tickets from the city or a government entity is a different story. Basically the government can enforce any measures they want.

The collecting agency will haunt you for years,
even you change your license plate.
But then, that's all they can do.

I have alot of parking tix.....over 20...dun worry, I still have my new credit card! They just always call you and I think I didn't change the licence plate tim....
作者: bbgun    時間: 2010-10-20 11:15

I agree with raffaello.

The "collection agency" impark is telling you about, is in fact, themselves. A change of license plate will do! Only $18, where you ticket is probably $70+? You could try to tell them but they will not waive your fine. I've tried calling them a lot before because i got ticketed for parking 3 hours at a 4 hour spot 198231223423 times. I never got towed because i parked on a level of a parking lot where tow trucks cannot access... too low =)
The only reason they waived my ticket was by telling them i never even GOT the ticket(probably works in your case against Diamond). Doesn't work after a few times. These private companies have no power in any way to access your credit information... ICBC just sells customer information to them.

they cant touch your credit..you can either try to reason with them or just ignore it

Diamond parking again.  Many years ago, I also had my FINAL notice without physically having a ticket.  And the funny part was that the ticket was from a place that my car never visited.  So obviously that ticket was wrong, but they don't listen.

Soon, their collector agent started bugging me (it is actually they own department, just diff name).  Like you, I don't want to bend backward to pay for this bogus ticket.  I sent letters and my wife helped talking to their agents (she is better in bargaining) a number of times.  First they offer to reduce the ticket price which is BS.  Anyway, after many calls, they took it out.  All you need is lucky to have a good agent on the phone with you that day.

I hated Diamond so much since then.  Yes, be strong and firm, and prepare to spend time with them.  Like other said, even their collect agent can't do much harm to you, so don't need to worry on that part.

I read on some site before when i was looking up Diamond and Impark, both crooks to be honest. Their staff gets commission per ticket SO... Hmm.

Back to the info stuff.

Some guy who worked at a decent position inside Impark said that... probably true considering there are no other ways they can find your name, address, and phone number with just your license plate number? I would probably word it as "ICBC sold info to these companies" rather than "companies bought the info

I parked in a 3 hr limit D. parking lot for 2 hr & got a ticket saying that i parked over 3 hr limit.
I called their customer service, tell them they issued the ticket by mistakes;  the agent wanted me to prove that i didn't parked over the limit or they won't cancel the ticket. WTF?
They made a mistakes & want me to prove it ?  i asked them how could they prove that I parked over 3 hr, they can't prove it either. (it was a hand written ticket, not generated by the hand-held machine which they input your licence plate# & then check again 3 hr later.)
the agent replied "they won't issue ticket unless i parked over the limit, bl ah blah blah..."

Also i called ICBC, the agent replied me that ICBC DOES provide customers info to parking company upon their request!!!

If you have a valid point, send a complain email to their regional manager.
You can look this up on their website.

I got off the hook this way about 2 years ago.
The regular agent offer 1/2 price as his best offer, and boom, the regional manager got it all off.

Good luck.

The same thing happened to me at Aberdeen Mall.  I went there for lunch and parked less than two hours at a regular parking stall, but got a ticket.  I ran down to the mall cop central and started yelling and made a scene.  They initial gave me the BS about contacting the parking company blah blah blah.  I got louder and louder and asked for their manager.  They finally backed off and took care of the ticket for me.

When dealing with parking ticket, you have to be tough and difficult to deal with.  They are always 欺善怕惡

here is a link about a person who didn't pay the parking ticket...

http://calgary.ctv.ca/servlet/an ... 025?hub=CalgaryHome

well, it also happened to my colleague  that she has a collection status on credit bureau because of the unpaid parking tickets from collection agency

I would agree not to pay if you are 100%+ sure that it will not affect your credit rating at all.  Every collection status stays on your credit bureau for 7 yrs.. It affects you for applying credit card, loan, line of credit, overdraft protection and mortgage.
My colleague didn't pay for his hundred dollars ticket a few yrs ago.. she is still regretting. Because of that small amount, she wouldn't qualify for visa and other loans.
If she would have known it, she would pay that amount...

it might or might not affect you, but if it affects your credit rating in the future because of small amount then it is not worth of saving that small amount of money...
also it didn't happen to you once... it does not mean it might not happen...

well... good luck.. Just FYI...

why spend so much time BS with those parking company??? just don't pay the ticket and change you liscens plate

don't believe that parking ticket collection will hurt you credit. if you are stupid enough to believe that is true, you deserve to be ticketed

remember the rule of thumb unless credit advance to you and you don't paid on time, nothing can hurt or damage your credit. even you have a mortgage, you dont meet you obligation, that wont damage your credit.
作者: smt    時間: 2010-11-19 09:18

If I did sth wrong, I don't mind paying for it.

Thing is, a lot of us got tickets for things we didn't do.
Changing license plate will prevent towing.
But I'm getting letters and calls every few days.
It's very annoying.

well if you are talking mortgage late payment, it does affect your credit rating...
i do work in financial industry. we do report late pymts on credit bureau. any late payment over 30 days is reported to credit bureau.. over two missed mortgage payment can sent you to collection and also late pymt would show on your credit bureau. if you still don't pay it til then, bank can put you to court, put your home for sell and still ask you to be responsible for any loss.

There are so many factors that would affect credit score.

If a person who has a credit score of < 630.. it really doesn't matter if you miss payment again or not because your credit history is already bad.
but for someone whose credit score is at 700+, it can dramatically hurt your score..

Again, i don't know for sure if unpaid parking ticket would affect credit score or not, but it did affect my colleague.
Anyways, i guess it is totally subject to each individual's discretion.
Like smt said, if i did sth wrong, i don't mind paying for it and that is.

If the fault is not yours, i definitely agree not to pay and deal with the parking company or collection til the end. Just provide proof and write letter and record time that what you dealt with them and the details.. if it affects your credit, you can still dispute it with equifax or transunion

you must working a financial institution with retail banking right?

generally only revolving credit shows on the credit report, LOC and credit card
it depend on how your mortgage is registared revolving or not. your financial institution must registared their mortgage as revolving account.

mortgage is not a loan, but is a evidence of loan

I worked in a call centre. My opinion is often the agent have no power or limited power to accommodate certain requests, e.g. waiving charges while they know themselves the caller should not be held accountable. Having said that, they might just tell you it's your fault, pay for it, blah blah blah like a robot. So, I say go straight to someone higher who can make the decision.
