you are just 4 weeks (give or take) from labour...... I will not recommend he quit. if ur husband had previously mentioned to the company about parental leave and anything happened before you deliver your baby, seek help/ legal advice. Sorry I don't think I am helping much here, but just dropping my 2 cents as a support作者: 布小熊 時間: 2013-3-8 09:32
I think he shouldn't quit and your husband needs to submit his parental leave request soon. I don't think anyone can take "parental leave" after he quit or being fired. But one can take EI if he's been laid off.
Request for Leave
The Act says that a request for pregnancy or parental leave must be made in writing at least four weeks before the proposed start date.
I'd suggest your hubby to start brushing up his CV /resume, and start looking for another job while still attending to this current one. follow 布小熊's advice RE: submit a parental leave request to his manager and see how he/she reacts.
Legally, he/she cannot lay off your hubby in such circumstance so your hubby is protected (coz if the company does lay your hubby off because of parental leave, then you folks can file lawsuit against the company, which most companies would try to avoid). Then start taking the time (during parental leave) to look for another job...life will get better that way.
I applied maternity EI before bb expected due day but that's maternity leave. That I know you can apply before child is born. But for parental leave, I can't find where in the website that specifies this.
But you can always call Service Canada or go to one of the offices to ask.
As for your husband's situation, I wouldn't recommend to quit...I think if he quit then no EI...rather he just wait to be "laid off"...that way he can get EI...During parental leave...he can try to find another job...'coz as far as I know, as soon as come back to work from parental leave, if he get laid off, he still can't get another EI...作者: Verver_sywang 時間: 2013-3-15 13:23
