I would think it's the left turn's fault.  You have to make sure the opposite lane cars are 100% slowing down before turning.

【明報專訊】一名華裔居民昨日駕駛四驅車在溫市西區左轉時，懷疑被一輛跑車撞至翻側。跑車司機輕傷送院，但四驅車司機卻奇蹟地毫髮無損，連調查的警員都感到不可思議，直呼這是「聖誕奇蹟」。

事主王先生對本報表示，昨日下午3時15分左右，他正在橡樹街(Oak St.)北向路段行駛，並打算左轉進入西57街(W. 57th Ave.)。他指自己看到交通燈轉黃，對面車道的車輛又距離相當遠，於是便左轉向西行駛。

王先生指出，這時對面車道一輛淺藍色本田Prelude跑車，突然加速衝至。王先生的車這時已經轉入馬路中間，跑車煞車不及，高速撞向王先生四驅車的右側車腹，當場將他的四驅車撞翻。

跑車的車頭受到嚴重損毀，機油漏滿一地。消防人員到場立即以吸油沙敷蓋油漬，並將頸部受傷的年輕華裔女司機送院救治。

而四驅車被撞翻的王先生則毫髮未損，令人不可思議。不過他指自己移民十年從未被撞過，因此受到很大的驚嚇，接受傳媒訪問時仍不住發抖。現場警員也對此嘖嘖稱奇，認為車輛被撞翻時的衝擊力相當大，而司機竟然連扭傷都沒有，簡直是「聖誕奇蹟」。王先生則歸功於自己駕車時繫上了安全帶，強調「如果沒有繫安全帶，我很可能已經飛出車外了」。

警方在錄取王先生的口供後，稍後將會向受輕傷的女司機落口供調查，以確定車禍原因。

If there's no witness, ICBC can says it's 50/50! and if the driver of the
Prelude lies, it will be SUV's fault!

I guess regardless... it will be the SUV's fault.

usually in these cases.........the one thatz turning left is always wrong......( thats what happened to my friend last time)

According to ICBC, all left turns cars are at fault no matter what. Unless there are witenesses to point out the Prelude is running the red light, the SUV is at fault 100%.

Straight going cars have right of way.

Running Red Light definition: The car passes the stop line after the light is red.

In the situation above, the SUV is turning left as the light turning yellow. So, the Prelude still has the right of way.

Again, ICBC uses the word "Generally" because there's no black and white. The adjuster can spilt the fault or put it all on the left turn car depends on witnesses testimony and the whereabout of the crash (crash at front or rear?) of the left turn vehicle.

Left turner will usually be taking at least 75% of fault (which means he is totally responsible to the accident, because vehicle travelling straight usually have right of way and at the most they usually would only get 25% of fault).

dun u think that Mr Wong (left turner) is confusing everyone? he says the light turns yellow, and traffic are still pretty far away on the opposite lane, so he proceeded to make his left turn. Just like how any accident would happen!

then all in a sudden the Prelude would accelerate and hit him from the side, causing his SUV to flip. The news didn't say what kinda SUV he has but it could be just a very light 97-00 CRV / RAV4 or even older's Sidekick etc. Especially sidekick, if it gets side impact i really doubt it can stay standing! So what could also happens here is Mr wong decides to make his left JUST before the light turns yellow, the prelude was still going 50+ and the young driver stepped on the gas instead of the brake because she freaked out.

If it's a Prelude, and the driver would only gets minor injury from the accident; i doubt she would be taking an impact over 50kph...so i would really doubt the statement "突然加速衝至"...

as for oil on the ground, for automatic vehicles there is always a tranmission cooler at radiator and that's where the coolant and oil spilling on the ground. it doesn't take a lot of effort to cause that.

so i would give at least 75% fault to the SUV, i think he is just trying to cover up his ass
