法庭大戰 反HST再勝一仗. 工商團體不上訴 《撤銷HST議案》交專責委會

-卑詩最高法院周五駁回6個工商業團體對反統一銷售稅（HST）運動的司法覆核，裁定反HST運動向卑詩選舉處（Elections BC）提交的簽名有效。負責核實該批簽名的卑詩選舉處稱，會遵循法庭決定，下周一去信省議會專責委員會，表明反HST運動的55.7萬個簽名不僅有效，更超過法定的要求數目，並且會把《撤銷HST議案》提交該委員會審議，以決定把議案呈交省議會表決，或者作全民公決。    卑詩最高法院首席法官鮑曼（Robert Bauman），周五早上宣讀13頁的判詞，表示不同意工商業團體代表律師高爾（Peter Gall）稱，反HST運動擬呈交省議會的《撤消HST議案》，缺乏憲法上的合法性（unconstitutional），只有聯邦國會才能夠取消HST 的說法。
鮑曼指出，議案只是涉及卑詩省與聯邦政府HST協議中卑詩省要撤銷HST的部分，這是在卑詩省議會司法管轄範圍之內，因此駁回工商業團體的覆核，並且要求卑詩選舉處履行它餘下的工作，即把《撤銷HST議案》呈交省議會專責委員會。
在法庭作出裁決之後，卑詩選舉處隨即發表聲明，表示會在周一去信省議會專責委員會，表明反HST運動的簽名已達到法定要求，及附上《撤銷HST議案》。選舉處指出，反HST運動所收集的有效簽名是 557,383個，而法定要求是299,611個，超出約86%。
本月11日，選舉處雖然確定反HST運動的簽名已經達到法定要求，但稱要待司法覆核完成後，才會把議案提交專責委員會。
反HST運動領袖溫德心（Bill Vander Zalm）及另一發起人德萊尼（Chris Delaney），對最高法院的裁決，表示振奮。 溫德心在庭外表示：「今日（周五）是卑詩省及民主的大日子，我想，很多人都會十分高興。」德萊尼則稱，《撤銷HST議案》將遞交省議會，如果執政自由黨省議員提出反對，他們就會提出罷免該個省議員。
而省財政廳長兼副省長韓仕新（Colin Hansen）表示，非常高興法官可以在短時間內作出裁決，但認為裁決不會對政府構成壓力，重申有關的程序應該繼續進行。
6個工商業團體亦發表聲明，重申不會就司法覆核提出上訴，他們稱司法覆核，只是想明確及肯定HST的前途，不過，聲明指出，周五法庭的裁決，仍未能解答究竟《撤銷HST議案》是否真正可以撤銷HST。

Either way, we have been already doomed to pay more taxes.

I don't mind to pay couple hundreds bucks more each year due to HST as long as the Liberal can keep BC prosper.

NDP has die hard supporters(union, teacher, nurse, etc.). If Liberal lose, NDP will be back. Even Mr Van can come back with his conservatives, they can never win the majority, unless they can partner with what is left of the Liberals after the election.

Beside the cut, prepare to pay more tax to cover the $16Billions if HST got repealed. I wonder who will be happy at the end, may be NDP or Mr Van.

I still want Liberal to be in power. I jsut don't want HST.

I'm not sure ... kick the liberals out and get the NDPs?  is Bill V. good enough to form a new party ...

Analysts said there is a possibility that the Liberal may call for an election and let BC voters to decide which party to run the office again if the issue of HST gets heated.

What kind of choices do we have? Liberal? NDP? Or another party?

... as much as i didn't like HST when it was announced, these politician are soo annoying!! I hate this move.

Today's Ming Pao said BC will need to pay back $16 billion to Federal, just wonder where the money will come from, cut from School or Healthcare? If recall is successful, there will be an early election as well, who is going to pay for it? it will be disaster for everyone living in BC!
