I would sue her for sure if I'm you.
Or we can learn from some Indian people who found fake witness in car accident, and swear that he drove by during that time and he saw that lady hit your mom and just so happen he rolled down the window during that time and he heard she said racist comment

Unless something changed?  or I don't think you have to pay deductable.  So, it make 100% sense to go through ICBC.  While I don't think sueing is necessary, but I think reporting to the police is a must!

I would just ignore her in this situation.  Get all the info needed and go to ICBC.  Suing won't do much in this case.
