May I ask you -- "based on the law of which country Google made its claim?"

This is my 3rd time to ask this question. Why don't you answer it instead of challenging me did not read the article CAREFULLY?

網上搜尋器一哥 Google,上周二宣佈退出中國巿場,將搜尋引擎轉移到香港,讓內地網民透過 Google.com.hk瀏覽沒經審查的搜尋結果,但前天(周二)該網頁在中國的搜尋服務幾乎癱瘓,意味 Google搜尋技術,不敵中國防火牆。前日下午 5時左右,內地網民陸續發現在 Google搜尋時,不管是「六四」敏感字詞或無關痛癢的搜尋,都顯示錯誤訊息。 Google初時發表聲明說,相信是因為提升技術後,部份檔案有「 rfa」字串,令中國防火牆誤以為與被禁的「自由亞洲電台」( Radio Free Asia)有關。
內地網民難到香港 Google

但幾小時後,搜尋服務又回復正常, Google證實問題與 rfa字串無關,其間也沒進行過任何維修或更動,令人相信是中國防火牆作怪,顯示中國有能力堵截內地網民到香港 Google網站進行搜尋。內地網民很生氣,北京網友說:「我想立即衝到街上抗議。」他指當局堵截網友用 Google,會令中國被排除國際主流社會外。投資分析師溫斯坦( Steve Weinstein)指出,「若類似情況不時出現, Google將會逐漸失去中國巿場佔有率。

so google & chinese, who will be the bigger lessor?

at the end..both google and china will be losers..but who will lose the most...then depends on how you are going to look it..can go both ways

The Chinese can certainly use Yahoo search or Microsoft search. These foreign search engines are still there.
But then the idea that Chinese have to use an American search engine is ridiclous. You don't see the Americans using a foreign search engine.
The biggest loser is the arrogant google. The biggest winner is Baidiu and the Chinese IT industries which can take even more market share than before. Also, more investment in Chinese IT sector will only mean a more robust Chinese software industry.

I reposted this which I posted on a different thread since it is more relevent here.

This is quoted from news - "谷歌的聲明強調,提供未經審查的中文搜索內容,這種做法「完全合法」,但「中國政府已經非常明確地表示,審查是一項沒有商量餘地的法律要求。」谷歌唯有把搜尋服務轉至香港。"

My question about Google's statement is - "based on the law of which country Google made this claim"?

First, if Google said it is based on the law of China, then it is impossible to claim its act of not complying with the censorship is legal.

Second, if Google said it is based on the law of America, then how would the law of America is applicable to China and the operation of google.cn is within China and under the jurisdiction of Chinese law.

The American law can only regulate what cannot be done overseas according to the American law since Google is an American company, but it cannot determine what can be done overseas since that is under the law of the country which Google operates within.

I just 以事論事, and I don’t understand why Google said that. At the meantime, I also welcome challenges.
