if you were filmed on a movie, tv show, news or etc when you are just walking on the street, can you sue them 侵犯私隱?
so many people are shooting pic on the str ...
It's like airforce flying on your private premises, which is allowed without asking for your permission of any kind. Some persons/professions have special authority to carry their duty in the public needless to acquire individual's consent.
However, none of the persons involved in the CX case has that kind of authority.
Tofu, the woman got a case there because the film was shot by a Cathay employee, she can sue Cathay for negligent.
Anyone other than the empolyees of Cathay shot the video should have been okay. I beg the Cathay management should have consulted their corporate lawyer and make the decision. A liitle price just to close the case legally, not that Cathay won't win the case.
If this case goes to court. In Hong Kong, 80% Cathay will win the case. In In Canada, 20% Cathay will win the case (if she has not go to the extreme to theaten the RCMP with a stapler). In States, there will be no case because she should have been throw into dentention immediately.
