上載侵權BT種子 全球首入罪

【明報專訊】「BT點對點檔案分享」網上下載電影的侵權行為，對電影業造成重大打擊。2005年海關    便成功追蹤並拘捕被網民稱為「BT黃大仙    」的「古惑天皇」。

2005年1月10日及11日，全球首宗檢控以BT（BitTorrent）發放電影的侵權案，網名「古惑天皇」的被告於3個不同時段在屯門    寓所內，於沒有版權擁有人的特許下利用BT上載3部西片，並貼上一個「大隻佬」公仔為記號供網友下載。

有求必應 網民稱「BT黃大仙」

「古惑天皇」又有「BT黃大仙」之稱，只要網民表示希望欣賞某部電影，他立即找來並製成「種子檔案」任由下載；又因他的「大隻佬」公仔標記，在新聞組裏十分有名。

海關首先與電影業成立了一個聯合小組，經近1個月偵查，從網上一個新聞組尋獲3部美國    電影，分別為《夜魔俠》、《宇宙深慌》及《選美俏臥底》的非法檔案，證實全為美國影協會員公司的作品，在網絡供應商及有關新聞組的合作下，發現侵權者是「古惑天皇」。海關帶同法庭搜查令到其寓所將他拘捕，在單位內檢獲400張電影光碟，大部分為盜版，還有那個網民很熟悉的「大隻佬」公仔。

海關落案起訴古惑天皇3項有關《版權條例》的控罪，他最終被判監3個月，成為全球首宗成功檢控同類侵權案件。裁判官強調，若再發現同類案件，則以販賣盜版光碟的案例指引判監6至12個月。

根據《版權條例》，任何人在沒有版權擁有人的特許下，分發該版權作品的侵犯版權複製品，損害版權擁有人的權利，可被檢控，最高可判監4年及每件侵權物品罰款5萬元。

Another example of why HK sucks these days.  First selling out people who invested in HK because of Low Income Tax (Tax Eviction claim from the US), then prosecute impossible case about IP stealing which will never be successful under other domestic laws around the world.

This is why I won't go back to HK to work, because the lack of personal freedom.  HK ppl are stupid if they don't fight this kind of corporation scheme.

IP is not comparable to property.  One cannot prove they lose sales because of ppl sharing files, because almost all downloaders probably won't give a rat ass about watching these crap movies anyways.  On the other hand, there are many smart consumers want to see if the movie is good to get DVD or Blu-ray copy to watch with home theatre, although they are not the majority.  Stoping file sharing simply won't force the public to buy their crap.  This is just a corporation sheme to milk out as much $$$ as possible in whatever means they can take (e.g. IFPI suing ppl in America to get $3K from each poor people who don't have the money/time and will to fight back).  At the end, only the lawyers win.

I bought many music CDs and movies because I downloaded them and found out those are great entertainment.  If not for files sharing, I won't discover m-flo and other great musicians around the world.  The music industry or movie industry will simply lose customer like me if not file sharing.
