Heard of this case yesterday. Other than speeding by 20~30km/hr, and not seeing the car parked in the middle lane, is there anything that the truck driver have done that'd constitute dangerous driving if not for hitting this car? Putting this particular case aside, doing what the truck driver did, the max one'd get is a regular speeding ticket.
The parked car on the other hand, parked the car in the middle lane on a highway, without flashing the emergency light. The diagram above is not even accurate. Other than the 3 highway lanes, there's actually a shoulder lane on the left of the 3 lanes. If your vehicle is starting to stall, one should immediately try to get to a shoulder lane before the vehicle loses momentum completely and put on the warning light. Stopping in the middle of the highway is just asking for trouble. Not to mention that the speed limit there is 70-80. There should be a lot of time between stalling and your vehicle loses momentum and gets to a complete stop.
I think if the only thing the truck driver did wrong is speeding, and he get charged for something much more serious due to this accident, he's very 無辜. Cuz with the assumption that the only thing he did is speeding and happen to not see the car being parked, then in my opinion the parked car have equal if not greater responsiblity. |
