詢問: 有人知道如何離婚嗎?

有個朋友想和有外遇的太太離婚, 是即時離婚不是等一年分居那種

我聽說加拿大的法律是,就算配偶虐待(精神或肉體),與別人通姦都好, 只要對方沒有收入受害者的一方依然需要負擔對方的生活費
想問有沒有人知道這是真的嗎?

我本來想跟他說假如只是為了不讓太太分家產的話,就算即時離婚,法官也可能判太太可以分到一半,但想搞清楚才給忠告
(他們還沒有小孩)

另外就是,要說配偶通姦的話,需要拿出什麼證據? 要請私家偵探拍照還是必須抓姦在床?

突然感覺到加拿大的婚姻法律在偏袒不工作,出軌,然後掩飾事實的人, 這樣的法律對安分工作忠心不二的配偶真的好不公平
好像就在鼓勵大家出軌似的....

難怪最近在香港看到文章說很多人認為加拿大是個非常多不忠配偶,多一夜情的地方....

Yeah .. Especially in chinese circle .. I have heard so many cases la.. and usually 太太 has 外遇 too ..

don't know if it implies to Canadian divorce...

but divorce actually contains 2 parts, they are divorce & alimony... & plz keep in mind that they are two seperate matters!!!

the concern that you're talking about is in fact the alimony part...
but it really depends on the case... as in, how the petitioer and the respondent present their information. & how the judge view this...

if both parties come into agreement on the terms, the process will be short & easy.
but of course that is not the usual scenario... the truth is, most of the time, they won't have an agreement and the case will be taken to court.
during the first phase, there's only file-ing documents & filling out what you want then what you have...
& wait for the court to anounce the date...
that's probably all I know, hope it helps.

ps: if your frd has any children, please take into consideration of their mentaliy. coz it DOES perform huge effect on their emotions.
